FilmTexture App — Terms of Use

These Terms of Use (“Terms”) govern your use of the FilmTexture iOS application (the “App”) developed by FilmTexture, based in Istanbul, Turkey. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. App Description

FilmTexture is a camera and photo editing application that enables you to capture photos and videos with real-time film stock filters, edit images with GPU-accelerated color grading tools, and apply authentic film effects. All image and video processing is performed entirely on your device.

2. Subscriptions, In-App Purchases, and Auto-Renewal

The App offers the following auto-renewable subscription plans:

FilmTexture Pro

FilmTexture Studio

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
• You can manage and cancel subscriptions at any time through your Apple ID Account Settings on the App Store or in your device’s Settings app.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Prices are in USD and may vary by region based on Apple’s pricing matrix. Price changes will be communicated through the App Store.

3. Free, Pro, and Studio Features

The App provides a limited set of features available to all users at no charge, including real-time preview with one film stock filter and basic photo capture. Free users do not have access to the photo editor, advanced effects (grain, bloom, halation), or full-resolution export.

FilmTexture Pro subscribers gain access to unlimited captures, all film stock presets, the full photo editor, advanced color grading adjustments, and full-resolution export.

FilmTexture Studio subscribers gain access to everything in Pro, plus Camera Connect (wireless photo transfer from Sony, Canon, and Fujifilm cameras) and the RGB Waveform professional monitor overlay.

The specific features included in each tier may be updated from time to time.

4. Device Permissions

• Camera (required) — Capturing photos and videos with real-time film filters
• Microphone (required for video) — Recording audio with video captures
• Photo Library (required) — Saving captures and editing existing photos
• Location (optional) — Geotagging captured photos
• Local Network (optional) — Receiving files from external cameras over WiFi

You can revoke any permission at any time through your device Settings. Revoking required permissions may limit App functionality.

5. On-Device Processing

All photo and video processing — including filter application, color grading, grain simulation, bloom effects, and all machine learning operations — is performed entirely on your device. Your photos and videos are never uploaded to, processed by, or stored on external servers. This is a core architectural guarantee of the App.

6. User Obligations

• You must be at least 18 years old to create an account
• You are responsible for maintaining the security of your account
• You must not use the App for any unlawful purpose
• You must not attempt to reverse engineer, decompile, or disassemble the App
• You must not attempt to circumvent any security features or access restrictions
• You must not use the App to create content that is illegal, harmful, or infringes on third-party rights

7. Intellectual Property

All intellectual property rights in the App, including but not limited to the software, design, film stock presets, filter algorithms, user interface, and proprietary processing techniques, are owned exclusively by FilmTexture. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal and professional purposes in accordance with these Terms.

Photos and videos you create using the App are yours. FilmTexture claims no ownership over your content.

8. Account Deletion

You may request deletion of your account and all associated data at any time:

• In the App: Settings > Sign Out, or contact us
• Via email: privacy@filmtexture.com

Account deletion will be completed within 30 days. Active subscriptions must be cancelled separately through the App Store before or after account deletion.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The App is provided “as is” and “as available” without warranties of any kind, whether express or implied.
• FilmTexture shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total aggregate liability shall not exceed the amounts you paid to FilmTexture through in-app purchases in the 12 months preceding the claim, or $100 USD, whichever is greater.
• FilmTexture is not liable for any loss of photos, videos, or data resulting from device malfunction, operating system issues, or circumstances beyond our control.

This limitation does not affect your mandatory consumer rights under applicable law.

10. Indemnification

You agree to indemnify and hold harmless FilmTexture from any claims, damages, losses, or expenses arising from your violation of these Terms, your misuse of the App, or your violation of any third-party rights.

11. Refunds

All subscription and in-app purchase refunds are handled exclusively by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support. FilmTexture does not have the ability to process refunds for App Store transactions.

12. Apple Terms

Your use of the App is also subject to the Apple Standard End User License Agreement (EULA). In the event of any conflict between these Terms and Apple’s EULA, Apple’s EULA shall prevail with respect to App Store-related matters.

You acknowledge that:

• These Terms are between you and FilmTexture, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims relating to the App or your use of it
• Apple is a third-party beneficiary of these Terms and may enforce them against you

13. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Consumer disputes are subject to the jurisdiction of Turkish Consumer Arbitration Committees and Consumer Courts. You may also have additional rights under the consumer protection laws of your jurisdiction.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

15. Changes to Terms

We may update these Terms from time to time. Changes will be posted at this URL with an updated date. Material changes will be communicated through the App. Your continued use of the App after changes constitutes acceptance.
