Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the FilmTexture website (filmtexture.com) and related services (collectively, the “Services”). By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

All products sold on FilmTexture are digital goods (digital content not supplied on a tangible medium). The essential characteristics, specifications, and system requirements of each product are described on its respective product page.

4. Right of Withdrawal and Refund Policy

Because our products are digital content not supplied on a tangible medium, the right of withdrawal does not apply once performance has begun with your prior express consent and acknowledgment that you will lose your right of withdrawal. This is in accordance with applicable consumer protection laws, including EU Directive 2011/83/EU (Article 16(m)) and Turkish Regulation on Distance Contracts (Article 15).

By completing a purchase, you:

Exception — Pre-Download Withdrawal: If you have not downloaded or accessed the product, you may request a full refund within 14 days of purchase by contacting hello@filmtexture.com.

Defective Products: If a product is defective, corrupted, or materially different from its description, you are entitled to a full refund or replacement regardless of download status. You must notify us within 30 days of purchase. We will resolve valid claims within 14 days of notification.

Upon purchase, you are granted a non-exclusive, non-transferable, perpetual license to use the product files for:

All intellectual property rights in the products, including but not limited to copyrights, trade secrets, and proprietary processes, remain exclusively with FilmTexture. Violation of these terms will result in immediate license termination without refund and may subject you to legal action for damages.

Neither party shall be liable for failure to perform obligations due to circumstances beyond their reasonable control, including but not limited to: natural disasters, war, terrorism, government actions, epidemics, pandemics, internet outages, power failures, cyberattacks, or acts of third-party service providers. The affected party shall notify the other party promptly and make reasonable efforts to mitigate the impact.

We strive to maintain availability of the Services but do not guarantee uninterrupted, error-free, or secure access. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

The Services may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, security, or availability of those websites or services. Your interactions with third parties are solely between you and the third party.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FilmTexture regarding the Services and supersede all prior agreements, understandings, and communications, whether written or oral.

16. Waiver

The failure of FilmTexture to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by FilmTexture to be effective.

17. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. FilmTexture may assign these Terms without restriction in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

18. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. We will provide reasonable notice of material changes. Purchases made before a change are governed by the Terms in effect at the time of purchase. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
