Part A — Pre-Information Form (Ön Bilgilendirme Formu)

A.5 Right of Withdrawal (Cayma Hakkı)

In accordance with the Regulation on Distance Contracts (Art. 15/ğ), the right of withdrawal does not apply to digital content that is not supplied on a tangible medium, once the performance has begun with the consumer’s prior express consent and acknowledgment that they will lose their right of withdrawal.

By completing a purchase and agreeing to the checkout terms, you:

  1. Expressly consent to the immediate delivery of digital content
  2. Acknowledge that you waive your right of withdrawal once the digital content is delivered (download link provided)

Exception: If you have not downloaded or accessed the product, you may exercise your right of withdrawal within 14 days of purchase by contacting hello@filmtexture.com.

A.6 Defective Products

If a product is defective, corrupted, or materially different from its description, you are entitled to a full refund regardless of download status. You must notify us within 30 days of purchase. Contact: hello@filmtexture.com with your order reference number.

A.7 Dispute Resolution (Uyuşmazlık Çözümü)

Disputes arising from purchases are resolved by:

Part B — Distance Sales Agreement (Mesafeli Satış Sözleşmesi)

In accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts

B.1 Parties (Taraflar)

Buyer (Alıcı): The individual whose identity, contact, and payment information is provided during the checkout process on filmtexture.com.

B.2 Subject of the Agreement (Sözleşmenin Konusu)

This agreement governs the rights and obligations of the parties regarding the sale and delivery of digital products ordered by the Buyer through the Seller’s website (filmtexture.com), in accordance with Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

B.3 Product Information (Ürün Bilgileri)

The essential characteristics, sales price (including all taxes), and payment method of the product(s) are displayed on the product page and the order summary before the purchase is confirmed. The product type is digital content not supplied on a tangible medium.

B.4 Price & Payment (Fiyat ve Ödeme)

B.5 Delivery (Teslimat)

Digital products are delivered instantly via download link upon successful payment. Delivery is considered complete when the download link is made available to the Buyer on the order confirmation page and/or sent via email. No physical delivery takes place.

B.6 Right of Withdrawal — Digital Content Exception (Cayma Hakkı)

In accordance with the Regulation on Distance Contracts, Article 15, paragraph (ğ):

“The right of withdrawal cannot be exercised for the delivery of digital content that is not supplied on a tangible medium, once the performance has begun with the consumer’s prior express consent and the consumer’s acknowledgment that they thereby lose their right of withdrawal.”

The Buyer, by checking the required consent box during checkout and completing the purchase:

  1. Gives express consent to the immediate delivery of the digital content
  2. Acknowledges and accepts that the right of withdrawal is waived once the digital content has been delivered (i.e., the download link has been provided)

If the Buyer has not downloaded or accessed the product, the right of withdrawal may be exercised within 14 days from the date of purchase. To exercise this right, the Buyer must send a clear statement to hello@filmtexture.com with their order reference number.

B.7 Warranty & Defective Products (Garanti ve Ayıplı Ürünler)

Digital products are provided “as described” on the product page. If a product is defective, corrupted, or does not match its description:

The Buyer’s rights under Turkish Consumer Protection Law regarding defective goods (ayıplı mal) are reserved and cannot be waived by this agreement.

B.8 Intellectual Property & License (Fikri Mülkiyet ve Lisans)

Upon purchase, the Buyer is granted a non-exclusive, non-transferable license to use the product files for:

All intellectual property rights in the products remain with FilmTexture. Violation of these terms may result in license termination without refund.

B.9 Limitation of Liability (Sorumluluk Sınırı)

FilmTexture shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the products, including but not limited to lost profits, data loss, or business interruption. Our total liability for any claim shall not exceed the purchase price paid by the Buyer for the relevant product.

This limitation does not affect the Buyer’s mandatory consumer rights under Turkish law, which cannot be limited or excluded by contract.

B.10 Force Majeure (Mücbir Sebepler)

Neither party shall be liable for failure to perform obligations due to circumstances beyond their reasonable control, including but not limited to: natural disasters, war, terrorism, government actions, epidemics, internet outages, power failures, cyberattacks, or acts of third-party service providers. The affected party shall notify the other party promptly and make reasonable efforts to mitigate the impact.

B.11 Dispute Resolution & Jurisdiction (Uyuşmazlık Çözümü)

This agreement is governed by the laws of the Republic of Turkey.

B.12 Agreement Acceptance & Effective Date (Sözleşmenin Yürürlüğü)

This agreement becomes effective when the Buyer checks the required consent boxes during checkout and completes the payment. By doing so, the Buyer declares that they have read, understood, and accepted all terms of this agreement and the Pre-Information Form (Part A).

Part C — General Terms of Use

C.1 Acceptance

By accessing or using filmtexture.com, you agree to be bound by these terms. If you do not agree, you must not use the website.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
